These Terms of Service (“Terms”) govern your use of OriKone (“the app,” “we,” “us”). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. Eligibility

You must be at least 13 years old to use OriKone. By using the app, you represent that you meet this requirement.

The app is intended for adults — typically parents or caregivers — to record information about their own child or a child in their care. You are responsible for any content you record, including content about another person.

2. Your account

You sign in to OriKone using Sign in with Apple. You are responsible for maintaining the security of your Apple ID and the device on which the app is installed.

You agree to provide accurate information when signing in and to not impersonate any other person.

3. Your content

You retain all rights to the moments, check-ins, photos, and other content you create in OriKone (“Your Content”). We do not claim ownership of Your Content.

You grant us a limited, non-exclusive license to host, store, transmit, and display Your Content solely to provide the app to you. We do not use Your Content for any other purpose. We do not sell it, share it with third parties for their own use, or use it to train AI models.

You are responsible for Your Content and for ensuring that you have the right to record and store it. In particular, if Your Content includes information about another person — including your child — you are responsible for handling that information appropriately.

Subscription terms

OriKone Premium is offered as an auto-renewing subscription with the following options (prices shown in USD; equivalent local price applies in your region as set by Apple):

A 14-day free trial is available the first time you subscribe. You will not be charged during the trial. Your subscription will automatically convert to paid at the end of the trial unless you cancel at least 24 hours before the trial ends.

Auto-renewal. Your subscription automatically renews at the end of each subscription period (monthly or annual) at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.

Managing or canceling your subscription. You can manage your subscription, change plans, or turn off auto-renew at any time in your Apple ID account settings (Settings → [your name] → Subscriptions on iOS). Cancellation takes effect at the end of the current paid period — you will continue to have access to Premium until then.

Free trial usage. Any unused portion of a free trial period is forfeited when you purchase a subscription, in accordance with Apple’s policies.

Refunds. All payments are processed by Apple and are subject to Apple’s refund policy. We do not directly process or refund payments. To request a refund, use Apple’s “Report a Problem” page (reportaproblem.apple.com).

Price changes. We may change subscription prices in the future. If we do, we will notify you in the app and through your Apple ID before the change takes effect, and your continued subscription after the change constitutes acceptance of the new price. You can cancel before the change takes effect if you do not agree.

Privacy and Terms links. This Terms of Service and our Privacy Policy apply to your subscription. Both are accessible from the paywall screen inside the app.

6. Not medical advice

OriKone is a journaling and reflection tool. It is not a medical device, not a diagnostic tool, and not a substitute for professional advice from a pediatrician, therapist, speech-language pathologist, psychologist, or other qualified professional.

The app may help you notice patterns in your child’s behavior, speech, or mood, but those patterns are not a diagnosis. If you are concerned about any aspect of your child’s development, please consult a qualified professional.

7. Intellectual property

OriKone’s name, design, source code, and trademarks are owned by us. These Terms do not grant you any rights to our intellectual property except the limited right to use the app as it is intended to be used.

8. Disclaimers

OriKone is provided “as is” and “as available”, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted, error-free, secure, or free from loss of data. While we take reasonable measures to back up and protect your data, you are responsible for keeping your own copy of any content that is important to you (the in-app PDF export is provided for this purpose).

9. Limitation of liability

To the fullest extent permitted by law, in no event shall OriKone, its operators, or its providers be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising from or related to your use of the app — even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to these Terms or the app shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.

10. Termination

You may stop using OriKone at any time. To delete your account and all associated content, use the “Delete account” option in the app.

We may suspend or terminate your access to the app if you materially violate these Terms.

Upon termination, the sections of these Terms that by their nature should survive termination (including ownership of Your Content, disclaimers, limitations of liability, and governing law) will continue to apply.

11. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. If we make a material change, we’ll do our best to notify you in the app before the change takes effect. Your continued use of the app after the change constitutes acceptance of the new Terms.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the app shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
